Terms and Conditions
These Terms and Conditions (the “Agreement”) constitute a legally binding contract between you (“User” or “You”) and PT Indo Cipta Estetika (“PT Indo Cipta Estetika,” “Company,” “we,” “our,” or “us”) governing your access to and use of any website operated by or on behalf of PT Indo Cipta Estetika (each, a “Website”).
By accessing or using the Website, you expressly acknowledge and agree that: (i) You are of legal age in your jurisdiction of residence and have the legal capacity to enter into this Agreement; (ii) You accept and agree to be legally bound by all provisions of this Agreement, which govern your use of the Website and any services, products, materials, or information made available through it; and (iii) You will comply with all applicable laws and regulations, as amended from time to time.
IF YOU DO NOT AGREE TO BE LEGALLY BOUDN BY AND COMPLY WITH ALL THE TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT, YOU ARE NOT AUTHORIZED TO ACCESS OR USE THE WEBSITE AND MUST IMMEDIATELY DISCONTINUE SUCH USE. We strongly recommend that you retain a printed copy of these Terms and Conditions for your records.
Privacy:
Without prejudice to the general applicability of the terms and conditions contained in this Agreement, your access to and use of the Website shall also be governed by the PT Indo Cipta Estetika Privacy Policy (the “Privacy Policy”), which is hereby expressly incorporated into, and constitutes an integral part of, this Agreement. You are advised to review the Privacy Policy thoroughly. By accepting the Privacy Policy, you expressly consent to the collection, use, and disclosure of your information by PT Indo Cipta Estetika and its affiliates, in accordance with the provisions of both this Agreement and the Privacy Policy.
Changes to the Agreement by PT Indo Cipta Estetika:
Subject to applicable law, PT Indo Cipta Estetika reserves the right, in its sole and absolute discretion, to amend, modify, or replace any provision of this Agreement, in whole or in part, at any time, without incurring liability or obligation to you or any other person or entity. In such event, the Company will publish the revised Agreement on the Website at least thirty (30) days prior to the effective date of the amendments, and the date of the most recent revision will be indicated at the top of this page.
Should you wish to reject the amendments, you may do so by delivering a written notice to the Company within thirty (30) days from the effective date of such amendments, using the contact information provided in this Agreement.
Registration and Account Security:
When making a purchase through the Website, you may either register for a PT Indo Cipta Estetika account (“Account”) or proceed with checkout as a guest. Should you choose to make a purchase as a guest, you will still be required to provide certain personal information in order for the Company to process your order (as further defined in Section 5).
By completing a purchase through the Website, you agree to: (1) Provide complete, accurate, and current information about yourself; and (2) Promptly update such information, if you have registered for an Account, to ensure it remains accurate and complete at all times.
You bear full responsibility for the accuracy and completeness of all information provided to PT Indo Cipta Estetika, whether purchasing as a guest or through an Account. Failure to provide or update accurate information, or circumstances in which the Company has reasonable grounds to believe that such information is incomplete or inaccurate, may result in the suspension or denial of your access to the Website, at the sole and absolute discretion of PT Indo Cipta Estetika.
If you register for an Account, it is your sole responsibility to maintain the confidentiality and security of your login credentials, including your password, and any other information provided by PT Indo Cipta Estetika. In the event your Account or password is used without authorization, or if you become aware of any security breach, you must immediately notify PT Indo Cipta Estetika via the Technical + Other section of our contact page. The Company shall not be held liable for any failure on your part to comply with this obligation, nor for any delay in deactivating your Account after you have reported such a security breach.
You remain solely responsible for any and all activities conducted under your Account, whether or not authorized by you.
Making Purchases through the Website:
You may only place Orders through the Website if you are at least eighteen (18) years of age. All purchases must be shipped to a valid mailing address, as determined at the sole and absolute discretion of PT Indo Cipta Estetika. Please note that the Company may not be able to deliver to all addresses. In such cases, the Company reserves the right, at its sole discretion, to cancel the relevant purchase transaction (“Order”). Should this occur, you will be notified, your Order will be canceled, and a refund will be issued, unless you provide an alternative shipping address that meets the Company’s requirements. The Company further reserves the right to decline expedited or alternative shipping methods.
The “Free Worldwide Shipping” offer is subject to minimum purchase requirements, which may vary by region and are subject to change from time to time. Unless otherwise expressly stated, all prices displayed on the Website are denominated in Indonesian Rupiah (IDR).
All Orders placed through the Website are subject to this Agreement as well as any additional terms and conditions applicable to purchases, returns, refunds, and deliveries as set forth on the Website. Prices, shipping terms, return policies, and other conditions may be amended at any time without prior notice. Prices available on the Website may differ from those offered through other sales channels.
By placing an Order, you have a legal obligation to complete payment for such Order. You agree to pay in full the purchase price, together with all applicable taxes, shipping and handling charges, and any other related fees, using a valid credit card or other approved payment methods. Payments are processed through a third-party service provider; PT Indo Cipta Estetika does not collect or store your financial information. While PT Indo Cipta Estetika will charge you only the invoiced amount, your financial institution may apply additional service or transaction fees, for which the Company assumes no responsibility.
PT Indo Cipta Estetika reserves the right, in its sole and absolute discretion, to amend the list of accepted payment methods at any time, including but not limited to credit cards and other payment options. Orders for which full payment has not been received and verified will not be processed. Orders that are incomplete or improperly completed may be declined or not acknowledged.
To complete an Order, you may be required to provide additional information necessary for processing, such as valid payment credentials (e.g., credit card number and expiration date). Merchandise is reserved only upon completion of the Order. Adding items to your shopping cart (“Cart”) does not reserve those items or guarantee their availability. Items may sell out while in your Cart, and if removed, it may indicate that the product is no longer available before your Order is finalized. PT Indo Cipta Estetika reserves the right, at its sole and absolute discretion, to modify pricing on the Website at any time, including prices of items already placed in your Cart.
You will be billed at the time your Order is placed. You are responsible for all applicable taxes related to your purchase. Taxes, including sales tax, may also be applied to shipping and handling, return shipping, gift packaging, or other fees, depending on the delivery location.
Disclaimer on Pricing and Availability:
PT Indo Cipta Estetika makes reasonable efforts to ensure the accuracy of product information and pricing on the Website. However, the Company does not guarantee that all product descriptions, images, pricing, or availability are error-free. The Company reserves the right to correct any errors, inaccuracies, or omissions, and to change or update information at any time without prior notice. In the event of a pricing or availability error, the Company reserves the right, at its sole and absolute discretion, to cancel any affected Orders and issue a refund where payment has already been made.
Shipping:
- Shipping Partners
The Company collaborates with third-party logistics providers, including but not limited to Gojek, Grab, JNE, J&T, DHL, and other designated delivery service providers (collectively, “Shipping Partners”), to facilitate the delivery of products purchased through the Website. - Delivery Process
All deliveries shall be carried out by the Company’s appointed Shipping Partners. By placing an order, Users acknowledge and agree that delivery services will be subject to the terms, conditions, and policies of the relevant Shipping Partner. - Delivery Areas and Availability
Delivery coverage, availability of services (such as same-day or express delivery), and applicable fees are determined by the Shipping Partners and may vary depending on the User’s location. The Company does not guarantee the availability of all delivery methods in every region. - Responsibility and Liability
(a) Title and risk of loss pass to the User upon the Company’s handover of the product to the Shipping Partner.
(b) The Company shall not be held liable for delays, damages, losses, or non-delivery caused by the actions, omissions, or service disruptions of any Shipping Partner.
(c) Users are responsible for providing accurate and complete delivery information. The Company shall not be liable for failed deliveries arising from inaccurate or incomplete information provided by the User. - Tracking and Confirmation
Where available, Users may track the status of their deliveries through tracking systems provided by the Shipping Partners. Delivery timelines displayed on the Website are estimates only and may be subject to change. - Changes to Shipping Partners
The Company reserves the right, at its sole discretion, to appoint, replace, or remove any Shipping Partner without prior notice, and to modify the shipping options offered on the Website.
If you do not receive your Order within 7 days from the estimated delivery time, notify us in the CONTACT US section. Please note that some Orders may not always be delivered together. Additionally, depending on the size of your order, you may receive multiple shipments to complete your order.
Rights Regarding Orders:
Without limiting any other provision of this Agreement, PT Indo Cipta Estetika reserves the right, at its sole and absolute discretion, to limit or refuse any Order placed through the Website. The Company further reserves the right to verify the validity of all Orders and to cancel any Order where there is evidence or reasonable suspicion of fraud, tampering, or any violation of this Agreement.
The Company may, at its discretion, restrict or cancel the quantity of items purchased per individual, per household, or per Order. Such restrictions may apply to Orders associated with the same Account, the same payment method, and/or the same billing or shipping address. PT Indo Cipta Estetika also reserves the right not to ship items to certain addresses. In such cases, you will be notified, and any amounts charged in connection with the canceled portion of your Order will be refunded or adjusted accordingly.
PT Indo Cipta Estetika Not Responsible for Errors:
PT Indo Cipta Estetika makes reasonable efforts to ensure that information provided in connection with the Website—including, but not limited to, product descriptions, pricing, promotions, offers, and availability—is accurate and current at the time of publication. However, the Website may, on occasion, contain typographical errors, inaccuracies, or omissions.
The Company reserves the right, at its sole and absolute discretion, to correct any such errors, inaccuracies, or omissions; to update or modify information; and to cancel any Orders affected by such errors or inaccuracies, at any time and without prior notice (including after an Order has been submitted).
Limitation of Liability
To the fullest extent permitted by applicable law, PT Indo Cipta Estetika shall not be liable for any loss, damage, cost, or expense (including indirect, incidental, or consequential damages) arising out of or relating to: (i) the cancellation, limitation, or refusal of any Order; (ii) corrections or updates to product descriptions, pricing, promotions, or availability; or (iii) any reliance placed by you on information made available through the Website that is subsequently found to be inaccurate or incomplete.
Electronic Transmission:
The transmission of data and information over the internet or any other communication network is inherently insecure and subject to potential loss, interception, or alteration while in transit. PT Indo Cipta Estetika assumes no responsibility or liability for any damages, losses, or costs you may incur as a result of any electronic transmissions conducted over the internet, other networks, or otherwise in connection with your use of the Website.
Under no circumstances shall any information you submit through the Website be deemed confidential, give rise to fiduciary obligations on the part of the Company, or result in any liability to you in the event such information is inadvertently disclosed by the Company or accessed by unauthorized third parties without the Company’s knowledge or consent. Users are strongly advised not to transmit personal or financial information to the Company via unencrypted email or other unsecured communication channels.
While the Company undertakes reasonable efforts to ensure that its Websites are accessible and functional across a variety of mobile devices and other platforms, Users are responsible for taking appropriate precautions to ensure compatibility of the Websites with their specific devices, operating systems, and configurations.
Website Ownership:
The Website contains various elements, including but not limited to graphics, text, icons, buttons, videos, audio, images, designs, trademarks, brand names, software, and other materials (collectively, the “Website Content”), which are provided by PT Indo Cipta Estetika and/or third-party contributors. All Website Content is the property of PT Indo Cipta Estetika and/or the respective third parties and is protected, to the fullest extent permitted by applicable law, by copyright, trademark, patent, and other intellectual property and proprietary rights.
You expressly acknowledge that your use of the Website and/or any Website Content does not confer upon you any ownership rights or other proprietary interests in the Website or any of its components, including the Website Content. Except as expressly authorized, nothing in this Agreement, on the Website, or within any Website Content shall be interpreted as granting, whether by implication, estoppel, or otherwise, any license or right to use any intellectual property of PT Indo Cipta Estetika or of any third party.
Trademarks:
Certain names, graphics, logos, icons, designs, words, titles, and phrases appearing on the Website and/or within the Website Content may constitute trade names, trademarks, registered or unregistered trademarks, or service marks (collectively, the “Trademarks”) of PT Indo Cipta Estetika or of other third parties.
Trademarks may be registered or unregistered in Indonesia and/or other jurisdictions, as applicable. All Trademarks not owned by PT Indo Cipta Estetika remain the property of their respective owners and, where used by PT Indo Cipta Estetika, are utilized under license or with the requisite authorization.
License of Use:
Upon your acceptance of the terms and conditions set forth in this Agreement, you are granted permission to access and use the Website. Subject to the provisions of this Agreement, PT Indo Cipta Estetika hereby grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable, and fully cancellable license to use the Website Content solely for your personal, non-commercial purposes, provided that all original copyright, trademark, and other proprietary notices are preserved in their original form.
This limited license does not extend to, and expressly excludes, any rights not explicitly granted herein. You agree not to engage in, authorize, or permit any use of the Website or any component thereof (including, without limitation, the Website Content) that is not expressly permitted under this license.
The limited license granted to you shall automatically terminate upon the expiration or termination of this Agreement, whichever occurs first.
Additional Restrictions:
Without limiting the generality of any other provision of this Agreement, you expressly agree that you shall not, whether directly or indirectly:
- Unauthorized Use
Use, copy, modify, download, or transfer the Website or any component thereof (including, without limitation, the Website Content), in whole or in part, except as expressly authorized under this Agreement. - Reverse Engineering and Source Code
Reverse engineer, disassemble, decompile, translate, or otherwise attempt to obtain or access the source code of the Website or any component thereof (including, without limitation, the Website Content), or create derivative works based on the Website or any part of the Website Content. - Third-Party Assistance
Permit, facilitate, or assist any third party in engaging in any of the prohibited activities set forth herein. - Commercial Exploitation
Lease, rent, lend, resell, sublicense, or otherwise distribute the Website or any component thereof (including, without limitation, the Website Content). - Ownership Notices
Remove, obscure, or alter any copyright, trademark, proprietary, or ownership notices contained on the Website or within any component thereof, whether belonging to PT Indo Cipta Estetika, or any third party. - Unlawful Use
Use the Website or any component thereof (including, without limitation, the Website Content) in any manner that violates this Agreement or any applicable laws or regulations. - Harmful or Unlawful Activities
Use the Website or any component thereof (including, without limitation, the Website Content): (i) to deceive, defraud, or mislead any third party; (ii) to transmit, publish, or distribute obscene, unlawful, or otherwise inappropriate material or information; and/or (iii) to disseminate or encourage conduct that may constitute a criminal offense, infringe the rights of others, or otherwise give rise to civil or criminal liability.
License to Use User Content:
B By using the Website and submitting, posting, uploading, or transmitting any content (“User Content”), you expressly agree as follows: (i) You grant to PT Indo Cipta Estetika a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free, non-exclusive, and unrestricted license to copy, reproduce, adapt, transmit, edit, modify, use, publicly display, distribute, translate, and create compilations and derivative works from any and all User Content, in any format or medium, submitted through the Website. (2) You irrevocably waive all moral rights in and to any User Content in favor of PT Indo Cipta Estetika and its authorized licensees, successors, and assigns, thereby permitting the unrestricted use of such User Content without further notice or compensation to you. (3) For greater certainty, this license entitles PT Indo Cipta Estetika to use, exploit, and incorporate any User Content or ideas you provide in any manner it deems appropriate, without obligation of any kind to you. (iv) All User Content submitted through the Website shall be deemed non-confidential. PT Indo Cipta Estetika assumes no responsibility to treat such content as confidential, regardless of any markings or representations to the contrary.
Termination:
If you breach any provision of this Agreement, as determined by PT Indo Cipta Estetika in its sole and absolute discretion, your right to access and use the Website and any component thereof (including, without limitation, the Website Content) shall immediately terminate. PT Indo Cipta Estetika further reserves the right, at its sole and absolute discretion, to modify, suspend, or terminate, whether temporarily or permanently, the Website or any component thereof (including, without limitation, the Website Content) or any of its features, at any time and for any reason, without prior notice or liability to you or any other person or entity. In the event this Agreement, or your right to use the Website, is terminated for any reason, the provisions of this Agreement shall survive and remain binding upon you with respect to your prior use of the Website and any matters arising therefrom. If you are dissatisfied with the Website or any component thereof (including, without limitation, the Website Content), your sole and exclusive remedy is to cease all use of the Website.
